Terms of Service

These Terms of Service govern your access to and use of the ZIWA Land platform, the ZIWA 360 owner portal, and all related services provided by Aghurmi Group. By creating an account or purchasing a plot, you agree to be bound by these terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using any ZIWA Land service — including the public website at ziwaland.com, the ZIWA 360 owner portal, and all related mobile or web applications — you confirm that you have read, understood, and agree to these Terms of Service. If you do not agree, you must not use our services.

These terms apply to all users: visitors, registered members, plot owners, and investors. Specific obligations that apply only to plot owners or investors are clearly indicated.

2. Platform Access & Accounts

Account Registration

To access the ZIWA 360 owner portal, you must create an account with accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts under the laws of your country of residence to register for a ZIWA Land account.

Account Security

You agree to notify us immediately at info@ziwalands.com if you become aware of any unauthorized use of your account. ZIWA Land is not liable for any loss resulting from unauthorized account access caused by your failure to secure your credentials.

Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or remain inactive for an extended period — with prior notice where possible.

3. Land Ownership & Contracts

ZIWA Land facilitates the purchase of agricultural land plots in Siwa Oasis, Egypt, operated by Aghurmi Group. Each land purchase is governed by a formal ownership contract signed between the buyer and Aghurmi Group, subject to Egyptian land registration law.

  • Legal title to your plot is registered in your name from the date of contract execution.
  • ZIWA Land acts as a farm management operator, not as the legal owner of client plots.
  • The ZIWA 360 portal provides digital records of your ownership — it is a management tool, not a substitute for your physical contract or official registration documents.
  • Plot transfers, sales, or inheritances are subject to Egyptian property law and must be coordinated with Aghurmi Group operations team.
  • ZIWA Land does not guarantee specific harvest yields or investment returns. Projections shown are estimates based on current conditions and should not be treated as financial guarantees.

4. Payment Obligations

Plot purchases are subject to the payment schedule defined in your ownership contract. By agreeing to an installment plan, you commit to the following:

Payment Schedule

Installments are due on the dates specified in your contract. Late payments may incur penalties as outlined in your individual agreement.

Transparency

All payment records are logged in your ZIWA 360 portal in real time. Quarterly statements are provided for your records.

Payment Methods

Accepted payment methods are specified in your contract. Online payments processed through the portal are subject to confirmation by our operations team.

Receipts

Official receipts are issued for every payment. These are available for download from your portal and serve as your legal proof of payment.

5. Farm Management Services

ZIWA Land provides agricultural management services as specified in your ownership contract. These services include land development, irrigation, planting, harvest management, and post-harvest processing. By engaging these services:

  • You authorize ZIWA Land's operations team to access and work on your plot as required for farm development and maintenance.
  • Development timelines provided are estimates. Delays due to weather, supply chain, or regulatory factors do not constitute a breach of agreement.
  • Farm log entries, stage updates, and photos shared in your portal are accurate records maintained in good faith by our operations team.
  • Service requests submitted through the portal will be reviewed and actioned within a reasonable timeframe as defined in your contract.

6. Intellectual Property

All content on the ZIWA Land platform — including but not limited to the ZIWA 360 software, design system, investment models, forecasting tools, brand assets, and written content — is the exclusive intellectual property of Aghurmi Group.

You may not reproduce, distribute, modify, or create derivative works from any ZIWA Land content without prior written consent. Your personal farm data (plots, zones, payment records) belongs to you; platform data and tools remain property of Aghurmi Group.

7. Limitation of Liability

To the fullest extent permitted by law, Aghurmi Group and ZIWA Land are not liable for:

  • Indirect, incidental, or consequential damages arising from platform use or farm operations
  • Loss of income or yield due to natural causes, market conditions, or regulatory changes beyond our control
  • Temporary platform unavailability for scheduled maintenance or technical issues
  • Third-party service failures (payment processors, cloud hosting, DNS providers)

Our total liability for any claim arising under these terms shall not exceed the total amount you have paid to ZIWA Land in the 12 months preceding the claim.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Arab Republic of Egypt. Any disputes arising from these terms or your use of ZIWA Land services shall be subject to the exclusive jurisdiction of the competent courts in Egypt.

For ownership disputes, Egyptian land registration law and the terms of your physical ownership contract take precedence over any conflicting provision in these digital terms.

9. Changes to These Terms

We may update these terms to reflect platform changes, new features, or regulatory requirements. We will notify all registered users by email when material changes occur. Continued use of the platform after notification constitutes acceptance of the updated terms.
